1. Agreement to these terms
These Terms & Conditions ("Terms") govern your access to Project Rocky, including rockyaloha.com and related features (the "Service"). The Service is operated by Craig Lindner, an individual in Hawaii, United States ("Project Rocky," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. What Rocky provides
Project Rocky is an AI pet rock companion that provides short, AI-generated perspectives for reflection and entertainment. Features and daily usage allowances are described on our Pricing page.
3. Eligibility and accounts
You must be legally capable of entering a binding agreement where you live. If you use a Rocky account, you are responsible for activity under that account and for keeping your sign-in access secure. Provide accurate information and notify us at support@rockyaloha.com if you believe your account has been compromised.
4. Acceptable use
You may not misuse the Service or attempt to interfere with its security or operation. This includes attempting to bypass usage limits, automate abusive requests, access another person's account, reverse engineer protected parts of the Service, introduce malicious code, or use the Service in violation of law or another person's rights.
5. Rocky Plus subscriptions
When available, Rocky Plus is offered as a monthly or annual automatically renewing subscription. Prices, features, and billing intervals are shown before purchase and on our Pricing page. Applicable taxes may be added at checkout. Stripe provides Managed Payments and serves as merchant of record. Purchases may be presented as sold through Link. We do not receive or store your full payment-card details.
Unless canceled, a subscription renews at the end of each billing period at the price then disclosed to you. If a recurring price changes, notice will be provided when required by law before the new price applies.
6. Cancellation
You may cancel your subscription through Link's order-management tools or by contacting Project Rocky support. Cancellation stops future renewals. Access may continue until the end of the paid billing period unless otherwise confirmed during cancellation. Cancellation does not automatically create a refund.
7. Refunds
Refund requests made within 14 days of a charge are eligible under our Refund Policy. Nothing in these Terms limits any non-waivable consumer right available under applicable law.
8. Creator Circle and referral links
Submitting a Creator Circle application does not guarantee selection, a physical package, payment, free services, exclusivity, or any other benefit. A personal share or referral link is provided for attribution and does not by itself create an employment, agency, partnership, sponsorship, or commission agreement. Any paid, gifted, affiliate, or sponsored arrangement requires separate written confirmation from Project Rocky.
Creator statements must reflect the creator's honest experience. If Project Rocky provides money, a free or discounted product, services, or another benefit and the creator mentions Rocky, the creator must clearly and conspicuously disclose that relationship with the endorsement and comply with applicable advertising and platform rules. Creators may not make unsupported health, financial, performance, or other claims about Rocky. We may reject an application or deactivate a referral link to prevent misuse, fraud, deception, or brand confusion.
9. AI-generated output
AI output can be incomplete, inaccurate, unexpected, or unsuitable for your circumstances. You are responsible for evaluating any output before acting on it. Do not submit confidential information or personal information that you do not want processed by the Service and its providers.
10. Availability and changes
We work to keep Rocky available, but we do not promise uninterrupted or error-free operation. We may maintain, update, limit, suspend, or discontinue all or part of the Service. Daily allowances are maximums, may reset on a schedule determined by the Service, and may be limited to protect reliability and prevent abuse.
11. Ownership
The Project Rocky brand, design, software, and related content are owned by Craig Lindner or the applicable licensors and are protected by intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable right to use the Service as intended; they do not transfer ownership.
12. Suspension and termination
We may suspend or terminate access when reasonably necessary to protect the Service, users, or others; respond to legal requirements; address fraud or abuse; or enforce these Terms. You may stop using the Service at any time. Subscription cancellation is handled separately as described above.
13. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, Project Rocky, Craig Lindner, and the Service's contractors and providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service. Our aggregate liability for claims relating to the Service will not exceed the greater of $100 or the amount you paid for the Service during the 12 months before the claim. This limitation does not apply where prohibited by law.
15. Governing law
These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law principles. Any dispute that is not subject to a non-waivable consumer forum will be brought in a court of competent jurisdiction in Hawaii. You retain any consumer protections that cannot lawfully be waived.
16. Changes to these terms
We may update these Terms. We will post the updated version with a new effective date and provide additional notice when required. Continuing to use the Service after an update takes effect means you accept the revised Terms.
